When Advocacy Equals a Diploma: A Special Education Success Story
As students head back to school, we’re reminded that every child deserves a fair shot—especially those with special education needs who depend on strong advocacy to succeed.
When Mrs. Jones* reviewed her son Angelo’s* assignments, she discovered his education plan had been changed to a non-standard track, without her consent. Concerned about his future, she turned to Legal Services, and pro bono attorney Sergio Pagliery of Shook, Hardy & Bacon stepped in.
Mr. Pagliery found vague assessments, incomplete plans, and major decisions made without parental input. Under Florida and federal law, students with disabilities are entitled to a Free Appropriate Public Education (FAPE), including individualized instruction, services, evaluations, and meaningful parental involvement. Angelo had received none of that.
Mr. Pagliery raised concerns and called for a five-hour, in-person meeting with more than 15 staff and specialists to address the deficiencies. This time, Mrs. Jones was fully informed and at the table. Mr. Pagliery conducted a detailed review of the proposed plan, demanding critical revisions before signing off. The outcome was transformative: Angelo’s plan was updated to include paraprofessionals, a behavior technician, and a dedicated intervention team—giving him the tools he needed to succeed.
In June, Angelo graduated. This fall, he heads to Barry University. “It’s remarkable how far he’s come. Much of the credit goes to his very dedicated mom,” said Mr. Pagliery. We’re grateful for Mr. Pagliery’s tireless pro bono work, which ensured Angelo’s rights were upheld—and his future protected.
