When Advocacy Equals a Diploma: A Special Education Success Story
As students return to school this month, we remember the challenges many face – especially those with special education needs who rely on strong advocacy to succeed.
When Mrs. Jones* reviewed her son Angelo’s* school assignments, she realized his educational plan had been changed to a non-standard track without her consent. Concerned about the impact on his future, she turned to Legal Services for guidance and assistance. That’s when pro bono attorney Sergio Pagliery of Shook, Hardy & Bacon stepped in.
As Mr. Pagliery began reviewing Angelo’s educational file, he uncovered serious issues – vague assessments, incomplete educational plans, and critical decisions made without parental input. Under both Florida and federal law, students with disabilities are entitled to a Free Appropriate Public Education (FAPE)—including specialized instruction, services, evaluations, and meaningful involvement from their parents. But Angelo’s records told a different story. It was clear that the very system designed to support him had instead failed him.
After raising serious concerns with school administrators, he called for a comprehensive, in-person meeting to ensure Angelo’s senior-year plan was both legally sound and genuinely responsive to his needs.
The meeting was not a small undertaking—it lasted nearly five hours and brought together more than 15 staff members and specialists. Most importantly, Angelo’s mother was present—this time, fully informed and represented at the table. Mr. Pagliery conducted a detailed, line-by-line review of the proposed educational plan during the session, demanding critical revisions and refusing to sign off until the necessary changes were made.
The outcome was transformative. Angelo’s educational plan was revised to include the support he needed, including paraprofessionals, a behavior technician, and a dedicated intervention team.
In June, Angelo graduated – and he’s now headed to Barry University this fall.
“It is remarkable how far he has come. Much of the credit for that has to go to his very dedicated mom,” reflected Mr. Pagliery.
